These Terms of Service (“Terms”) govern your access to and use of the website [https://easternbluegrass-rentals.com] (the “Site”) and all rentals and related services provided by [Eastern Bluegrass Rentals LLC] (“Company,” “we,” “us,” “our”). By using the Site or renting equipment from us, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Services.
You must be at least 21 and hold a valid driver’s license appropriate for the rented equipment.
You represent that all information you provide is accurate and you will keep it updated.
You are responsible for maintaining the confidentiality of your account and for all activities under it.
Prices are listed on the Site or in your invoice/quote and may change until a booking is confirmed.
Payment Method: Credit cards only. Using a debit card will result in order cancellation and a $25 reservation hold that is not refunded.
Security Deposit: A refundable $500 (unless otherwise stated) damage/security deposit is required at or before pickup/delivery. We may charge your card for amounts owed under these Terms.
Reservation Fee: A non-refundable reservation fee of $25 is required to hold equipment. The reservation fee combined with the rental price and will be refunded at the end of the rental with the security deposit if no issues occur.
Unless a different policy is stated in your invoice or a promotion:
7+ days before rental start: Full refund of rental fees paid (excluding any non-refundable reservation fee).
3–6 days before start: 50% refund of rental fees paid (excluding any non-refundable reservation fee).
<72 hours before start / No-show: No refund.
Early returns do not qualify for partial refunds. We may cancel a booking due to safety, weather, maintenance, or unavailability; if so, your sole remedy is a refund of fees paid for unused days.
You must inspect equipment at pickup/delivery and note any pre-existing damage on the check-out form.
Return Condition: Return equipment clean, fueled (if applicable), and on time.
Late Returns: A late fee of [one additional day’s rate] may apply plus any additional losses we incur.
Cleaning/Fuel Fees: [ $175 cleaning fee] and [market fuel rate + $10] if returned excessively dirty or not fueled.
For your safety and our property protection, you agree not to:
Operate under the influence of alcohol, drugs, or impairing medications.
Exceed posted speed limits or manufacturer/terrain limitations; carry more passengers than seats; perform stunts, racing, jumping, rock-crawling, or other hazardous maneuvers.
Tow beyond rated capacity or operate outside permitted areas or on restricted/private land without permission.
Allow anyone not listed as an authorized operator to use the equipment.
Remove, disable, or tamper with GPS/telematics or safety equipment.
Helmets and appropriate safety gear are strongly recommended and may be required by law. You must follow all applicable laws and manufacturer instructions.
Our equipment may include GPS/telematics that collect location, speed, and usage diagnostics during your rental for safety, asset protection, theft prevention/recovery, and contract enforcement. By renting, you consent to this monitoring. See our Privacy Policy for details.
You are responsible for all loss, theft, damage, misuse, excessive wear, and related costs occurring during your rental, including parts, labor, towing, loss-of-use, diminished value, and administrative fees.
We may apply your security deposit and charge your card on file for amounts owed.
You agree to promptly report incidents/accidents and cooperate with investigations and insurance claims.
If we deliver/pick up equipment, ensure safe vehicle access and a responsible adult present. Missed appointments may incur additional fees.
Off-road operation and towing carry inherent risks. You knowingly assume all risks of injury, death, or property damage arising from your use or misuse of the equipment.
To the fullest extent permitted by law, you release and agree to indemnify, defend, and hold harmless the Company and its owners, employees, and agents from any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from or related to your rental or breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
You are responsible for maintaining any legally required auto liability/comp coverage and confirming whether your personal policy covers towing, trailers, and off-road equipment. Our insurance (if any) is secondary and subject to policy terms and exclusions.
The Site, content, logos, and trademarks are owned by us or our licensors and protected by law. You may not copy, modify, or use them without permission.
Services and equipment are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.
To the fullest extent permitted, our total liability for any claim shall not exceed the amounts you paid for the applicable rental. We are not liable for indirect, incidental, special, punitive, or consequential damages.
We may refuse or terminate rentals or Site access for violations of these Terms, safety concerns, fraud, non-payment, or as required by law.
We may modify the Site, Services, prices, or these Terms at any time. Changes are effective upon posting with an updated Effective Date. Continued use indicates acceptance.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules.
Venue for any permitted court proceeding shall be [Rockcastle County, Kentucky].
Optional Arbitration Clause (choose to include or remove): Any dispute arising out of these Terms shall be resolved by binding arbitration in Rockcastle, County under local rules. You waive class actions and agree to individual claims only. Small-claims court remains available.
You consent to receive communications electronically (email, SMS) and agree that electronic signatures and records are valid and enforceable.
If any provision is found unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights without our consent.
